Program Terms and Conditions

A. Definitions of Program Terminology

  • Program – The ESS Clinical Refer a Friend Program
  • Referrer – A person who refers others from their network to join ESS Clinical
  • Referral – A person who gets referred to ESS Clinical by a Referrer
  • Reward – A $750 payment (or prorated amount for part-time referrals) to referers who submit eligible Referrals through the ESS Clinical Refer a Friend Program

B. Overview of the Referral Process

  1. The referer fills out the Refer a Friend form at ESSClinical.com/Refer
  2. The referred candidate must apply, get hired, and meet the minimum work requirements over their first 120 working days for the referer to receive the Reward.

C. Who Can Refer

The Program is open to the public with certain exceptions. Non-corporate ESS employees, contractors, school district staff, parents/guardians of district students, community members, and more are welcome to submit referrals.

  1. The Program is open to legal residents of the fifty (50) United States (including the District of Columbia) who are at least eighteen (18) years of age. This includes employees, contractors, and non-employees.
  2. Self-referrals are not permitted.
  3. Agencies and third-party staffing firms are not eligible.

D. Referral Requirements

  1. The candidate must be new to our database (no active application or engagement within the prior 12 months).
  2. The candidate must meet role-specific requirements and be eligible to work.
  3. The candidate must maintain a continuous active assignment for 120 working days (approved leaves do not count toward this threshold).
  4. Only one referral reward can be awarded per candidate. If multiple people refer the same person, the first-submitted valid referral is credited, for the first qualifying placement only.
  5. Referrals from agencies or third-party staffing firms are not eligible.

E. Referral Payment Details

Once the referred candidate completes 120 working days with ESS Clinical, our team verifies the fulfillment of all qualifications. Payment is issued within 30 days of verification.

  1. $750 will be awarded for full-time, year-round hires (at least 35 hours per week, 36–40 weeks per year on average during the first 120 working days).
  2. Part-time referral rewards are prorated using the formula: Reward = $750 × (average weekly hours ÷ 35), capped at $750.
  3. Non-employees are paid via check or ACH. If the total bonus amount in a calendar year exceeds $600, a 1099-NEC will be issued.
  4. Employees are paid via payroll and are subject to standard tax withholdings.

F. Additional Considerations

  1. No purchase necessary.
  2. All Rewards are non-transferable, and no substitution will be made except as provided herein at ESS Clinical's sole discretion. ESS Clinical reserves the right to substitute a Reward for one of equal or greater value if the designated award should become unavailable for any reason.
  3. By receipt of any Reward, Referrer agrees to release and hold harmless ESS Clinical, Source4Solutions, LLC, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and each of their respective parent companies and each such company’s officers, directors, employees and agents {collectively, the “Released Parties”} from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Program or receipt or use or misuse of any Reward.
  4. ESS reserves the right to cancel, suspend, and/or modify the Program, or any part of it, if any fraud, technical failure, or any other factor beyond ESS Clinical's reasonable control impairs the integrity or proper functioning of the Program as determined by ESS in its sole discretion.
  5. The Released Parties are not responsible for (1) any incorrect or inaccurate information; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in software; (3) unauthorized human intervention in any part of the Program; (4) technical or human error which may occur in the administration of the Program or the processing of Referrals; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Referrer’s participation in the promotion or receipt or use or misuse of any Reward.
  6. Participation constitutes Referrer’s full and unconditional agreement to these Terms and Conditions, and all decisions made by ESS Clinical, which are final and binding in all matters related to the Program. Receiving a Reward is contingent upon fulfilling all requirements set forth herein.
  7. Void where prohibited by law.
